La cohabitation au Canad a de deux grandes deux familles du droit\, celle de la Common Law et celle du droit civil\, génère une réflexion concrète sur le bijuridisme qui inc lut nécessairement un lien avec la langue et la culture. Cette réflexion a fréquemment été nourrie par la confrontation des règles du droit fédéral avec celles du droit provincial de même que celles du droit public avec ce lles du droit privé provincial. La modification de la loi fédérale d’inter prétation et les travaux d’harmonisation qui l’ont accompagnée ont placé c e sujet  à l’avant-scène du droit positif. La réflexion sur le plurijurid isme\, le pluralisme et  l’interculturalisme se situe parallèlement au pro cessus d’harmonisation des lois. Peu souvent associés au droit positif\, c es trois courants se situent pourtant en aval du bijuridisme et en sont pe ut-être la suite naturelle dans le contexte d’une société qui vit la globa lisation au quotidien. Loin d’être débranchés de la réalité\, le plurijuri disme\, le pluralisme et  l’interculturalisme portent le germe d’une inter prétation des lois adaptée au contexte quotidien des rapports juridiques m ultilingues et multiculturels et recèlent probablement plusieurs réponses utiles lorsqu’il devient nécessaire de résoudre des litiges. La réflexion sur le bijuridisme ouvre la porte à une possible intégration du pluralism e dans l’ordonnancement juridique canadien. Le transsystémisme dont se réc lame certains programmes a-t-il une identité propre ou n’est-il qu’une éta pe vers un certain interculturalisme? Le plurijuridisme véritable est-il u ne utopie? Speakers The Honourable Marie Deschamps After having practic ed as a litigator in criminal\, civil and commercial law in both small and large law firms\, the Honourable Marie Deschamps was appointed to the Que bec Superior Court in 1990\, to the Court of Appeal in 1992 and to the Sup reme Court in 2002. She retired from the judiciary in August 2012. She cur rently devotes her time to continuing legal education and to students. She has been an adjunct professor at the University of Sherbrooke's Faculty o f Law since 2006 and is presently an adjunct professor at Â鶹´«Ã½ÍøÕ¾ Universit y. Her areas of interest include constitutional law\, commercial law and e thics. Professor Adrian Popovici Adrian Popovici is a professor emeritus (Faculty of Law\, Université de Montréal) and an affiliate member (Â鶹´«Ã½ÍøÕ¾ ).  He is a Â鶹´«Ã½ÍøÕ¾ Faculty of Law graduate (1962) and the author of La cou leur du mandat (1995).  His interests lie in civil and comparative law. P rofessor Stephen Smith Professor Stephen Smith teaches and researches com mon law and civil law obligations and legal theory. A former law clerk to Chief Justice Brian Dickson\, Professor Smith taught for a number of years at St. Anne's College\, Oxford University. He is the author of Contract T heory (2004) and Atiyah’s Introduction to the Law of Contract\, 6th ed (20 05). In 2008\, Professor Stephen Smith received a Killam Research Fellows hip from the Canada Council for the Arts for his project 'Court Orders and the Replication\, Transformation and Creations of Rights'.
